All Images and Artwork created by the Artist Carla Jane are the sole property of Carla Jane, Owner of Carla Jane Art and are covered by the UK Copyright, Designs and Patents act 1988

Anyone found to be in breach of copyright will be pursued to the full extent of the law.
 

Requirements for Commissioned work
 

All private commissioned work is created from photographs, to be supplied by you, the client.

Photographs should be the best quality you have to offer, this is very important, with as high a resolution as possible (please ask if unsure about this requirement). Please choose good lighting, good composition and a close subject matter with as much detail as possible for me to create your chosen portrait.

The quality of your photographs may ultimately determine the outcome of your finished portrait.

I, the Artist Carla Jane have been creating bespoke portrait work for many years and work to a very high standard with a highly detailed specification.

An assumption will have been made by you, the client, that you have taken this into consideration when choosing me to create your chosen portrait, therefore I would ask that you please trust my judgment as a professional Artist when creating your portrait.

Advice and guidance can and will be offered should you require it at any point.

All work is created using only the highest quality lightfast and archival art materials available to ensure every portrait is made to last for many years for you to enjoy.
 

Deposits and Payments
 

A non refundable deposit of 40% of the quoted price will be required to book your slot in my diary, payment of this deposit guarantees your space and quoted price, total payment of all outstanding monies owed will be required on completion of your portrait or before should you wish to do so.

Where payment cannot be completed in this time state, an extension may be granted at the Artists discretion.
Please take into consideration the time of year when booking your commission as there may be a wait of a few weeks to several months so please check availability to avoid disappointment.

An approximate start date for your portrait to begin will be given at the time of booking when your deposit is recieved, should you wish to choose an alternative later date, please check with me, the Artist, what slots are available to you, the client, for your convenience
 

Alteration charges

I, the Artist, make every effort to ensure that you, the client, are happy with your portrait and the work I have carried out.

Whilst most alterations are easily changed eg. hue and tonal values or slight changes to areas of the portrait, these would be considered as minor alterations and therefore no extra charge is required.

Should any major alterations be required, for you, the client and not considered to be necessary by the Artist, then time taken to make such alterations will warrant an extra charge, this will be discussed and agreed before any alterations are made if necessary.

It is at the Artists discretion what constitutes as minor or major changes to the artwork.

All decisions will be made fairly and discussed accordingly before making any alterations.
 

Non completion of Payments

If you, the client, decides that the commission is no longer required for any reason and work has already commenced, the Artist retains the right to keep the deposit for time and materials lost.

If for any reason outstanding payments are not paid in full as agreed and I, the Artist have not received any communication from you, the client, you will have 30 days after notification of completion of the work to contact me and pay the remaining balance in full, if after 30 days, no correspondence has been received then the Artist reserves the right to exhibit and rework the created artwork where appropriate to resell if necessary to recoup income lost.

Under no circumstances will any artwork be shipped without full payment being received, including postage and packaging fees for shipping as agreed.

Copyright and use of Commissioned Artwork

The Artist retains the right to display and share work in progress shots on all of my business pages as well as my social media accounts.

Please state in writing, before work is commenced, if you wish for it to be kept a secret until such time that your portrait has been received and/or gifted to the recipient and arrangements will be considered at that time.

The Artist cannot be held responsible for a surprise gift being seen if no communication was admitted in writing to the Artist beforehand asking for the artwork to be kept secret. 

Completed artwork will be scanned and saved for portfolio reference and for you, the client, should you wish to order prints or printed products of the Artwork created for you, the client at any time in the future.

The Artist retains the right to use the image for advertising of artistic works and services, through printed an social media platforms and personal websites.

The finished Artwork may be used by you, the client, for display and personal enjoyment only.

No Prints or copies are to be made for profit or gain in any way from the finished artwork by you, the client, or any acquaintances, without the express written permission of Carla Jane, the Artist.

In all circumstances, the copyright of the finished Artwork is retained by and remains with Carla Jane, the Artist.
 

Termination of work by the Artist

Carla Jane, the Artist, reserves the right to terminate any commission agreement or work in progress at their discretion.

A commission can be cancelled or refused for any reason including, but not limited to, repeated rudeness in correspondence, failure to accord with the above terms and conditions, unreasonable requests or demands to the Artist, threatening language or behaviour or any form of harassment.
